This is a case about voting procedures in Ohio’s 2020 general election. On August 12, 2020, the Ohio Secretary of State issued directive 2020-16, which interpreted Ohio law to require each county board of elections to provide only one absentee ballot drop-off location. The plaintiffs here are three nonpartisan civil rights organizations — the A. Philip Randolph Institute of Ohio, the League of Women Voters of Ohio, and the Ohio State Conference of the NAACP — and seven individual Ohio voters. On August 26, 2020 they sued the Ohio Secretary of State in the U.S. District Court for the Northern District of Ohio, alleging that directive 2020-16 violated their fundamental right to vote under the First and Fourteenth Amendments and the equal protection clause of the Fourteenth Amendment. Represented by the Lawyers Committee for Civil Rights Under Law and private pro bono counsel, the plaintiffs sought declaratory relief, an injunction against the directive, an order for the Secretary of State to immediately permit boards of elections to install multiple secure ballot drop boxes and return absentee ballots to any polling place in their county of residence, and attorneys’ fees and costs. On September 4, 2020, the plaintiffs moved for a preliminary injunction, requesting the same relief. 

Then-President Donald Trump’s campaign moved to intervene in the action on September 10, 2020 under FRCP 24(b), which allows the court to permit “anyone to intervene who . . . has a claim or defense that shares with the main action a common question of law or fact.” The district court, per Judge Dan Polster, granted the motion on September 15, because it was “undisputed” that the campaign had a defense with a common question of law or fact with the main action. 2020 WL 5524842. 

Meanwhile, the Ohio Democratic Party and others had challenged the directive in state court, arguing that since Ohio state law said nothing about the off-site delivery of ballots, the Secretary of State’s interpretation of Ohio law to limit ballot drop-boxes was arbitrary and capricious. The state trial court agreed that it was in Ohio Democratic Party, et al. v. Frank LaRose, Secretary of State, et al., Case No. 20 CV 5634, (Franklin Cty. Common Pleas Ct. Sept. 15, 2020). The Secretary of State appealed the decision to the intermediate state appellate court. 

Back in federal court, Judge Polster presided over preliminary injunction hearings on September 23 and 24, 2020. On September 25, the district court issued its opinion, “holding in abeyance any ruling on Plaintiffs’ motion for a preliminary injunction to see if the conclusion of the state litigation [i.e., resolution of the Secretary’s appeal in the plaintiff’s favor] moots this case.” Further, the court found that limiting counties to a single ballot drop-box location would create a “crisis” for voters in larger counties, who would be stuck in traffic jams while trying to deliver their absentee ballots in-person to a single location all at once. The court ordered “the Secretary of State to work closely with the Cuyahoga County board of elections to develop and implement a plan to alleviate the looming crisis” while the state court litigation resolved, and to file a timely report on those efforts. 2020 WL 6600102. 

Over in state court, on October 2, 2020 the Ohio Court of Appeals affirmed the trial court’s finding that the directive was an unreasonable interpretation of state law, but reversed the trial court’s injunction, meaning directive 2020-16 remained in place.

Then, on October 5, 2020, the Ohio Secretary of State issued a new directive, 2020-22, which “authorized any board to deploy its staff to receive ballots at sites other than the board office.” In response to that action, Judge Polster on October 6 dismissed the plaintiffs’ action without prejudice. The court found that the new directive “alleviat[ed] many of the concerns raised at the [September 23 and 24 preliminary injunction] hearing[s]” and would allow at least the Cuyahoga County (Cleveland) board of elections to implement its plan to receive absentee ballots in six locations throughout the county. The plaintiffs moved for reconsideration of the dismissal the same day. 

Judge Polster granted the motions for reconsideration and for a preliminary injunction on October 8, 2020. After the district court’s dismissal, the Secretary of State on October 7 sent an email to the Cuyahoga County board of elections clarifying that the language “outside the office” in directive 2020-22 did not permit the board to deploy staff to any remote location in the county to collect ballots. The district court found that, in light of the Secretary’s clarification, directive 2020-22 did not “actually solve the problem” — the “looming crisis” — that the district court had identified in its October 6 order. Therefore, the court had been wrong to dismiss the action. 

Moving on, the court found that the organizational plaintiffs had standing because they had to divert significant resources to handle the directive, the defendant had caused the directive, and an injunction against the directive would remedy the resource strain. As to the individual voter plaintiffs, at least one of them had alleged a burden on their right to vote that was sufficient to cause injury-in-fact, and the causation and redressability analysis went the same way as that for the organizational plaintiffs did.

On the preliminary injunction factors, the court found that plaintiffs had demonstrated that they were likely to succeed on the merits. The court applied the Anderson-Burdick framework for evaluating constitutional challenges to specific provisions of a state’s election laws. The court first found “that the combination of the [d]irective limiting counties to a single drop box location and the disproportionate effect it has on people of color living in larger counties and cities imposes a significant burden on Plaintiffs’ fundamental right to vote.” Second, it found the state’s asserted justifications of its directive — providing voters ballot security and limiting the risk of voter fraud — did not serve a state interest. There was “no evidence in the record that suggests that multiple drop boxes cannot be as secure as the single drop box,” or that there was any risk of fraud. So, it was “not even a close question” that the plaintiffs were likely to succeed on their 1A and 14A claims. Because there was a likely constitutional violation, the plaintiff would suffer irreparable harm absent injunctive relief — relief which would also serve the public interest. The court granted the motion for a preliminary injunction. 493 F.Supp.3d 596. 

The defendants appealed the district court’s order the same day, October 8, 2020 (USCA no. 20-4063). The next day, October 9, the Sixth Circuit stayed the injunction pending appeal. Circuit Judge Richard Allen Griffin wrote the opinion, which Circuit Judge Amul R. Thapar joined and from which Circuit Judge Helene N. White dissented. The court of appeals found that the defendant would likely succeed on the merits. Unlike the district court, the court of appeals’ application of the Anderson-Burdick framework found the directive placed only a slight and non-discriminatory burden on voters, who had many other means of voting besides at an absentee drop-box. The court then found the directive to serve four legitimate state interests: uniformity, efficiency, accuracy, and security of elections. On the other stay factors, the court found that the injunction would cause irreparable harm to Ohio’s election process (by impinging on the four state interests), would not harm anyone, and was in the public interest. Accordingly, the court granted a stay of the injunction pending a full appeal. Judge White dissented from the opinion and would not have granted the stay because, in her view, the district court did not abuse its discretion. 831 Fed.Appx. 188. 

In light of this Sixth Circuit opinion, on October 22, 2020, the plaintiffs filed a stipulated order of dismissal against the Secretary of State, which the district court granted on October 23. The dismissal dissolved the previously granted injunction. The court of appeals on October 28 dismissed the case there on the Secretary of State’s unopposed motion to do so. 2020 WL 7980224. The case is now closed.

Minute Order [non-document] - On September 8, 2020, the Court held a teleconference. The Court discussed Plaintiffs' motion for preliminary injunction and related state court case with the parties. Defendant's counsel represented that it is their position that the statute at issue does not allow for more than one drop box per county. However, if a court directs otherwise, the Secretary will follow that order and allow additional drop boxes. The Court will adhere to the principle that it is to construe statutes to avoid constitutional conflict. Therefore, the parties shall address in their briefing, and at the hearing, whether the statute prohibits any County Board of Elections from authorizing more than one secure drop box, and at sites other than the Board itself. Due to the urgency of a final decision, the Court's Order will consolidate Plaintiffs' motion for preliminary injunction and permanent injunction pursuant to Fed. R. Civ. P.65(a)(2). Defendant shall file its response to Plaintiffs' motion for preliminary injunction no later than September 16, 2020, and Plaintiffs shall file its reply to Defendant's opposition motion no later than September 21, 2020. The parties shall exchange exhibits, with copies sent to the Court, no later than 12:00 noon on September 21, 2020. A hearing will be held via Zoom on September 23, 2020, at 9:30 am. The Court will provide the parties with instructions as to how to access the hearing. As stated in the Court's September 9, 2020 Order, the preliminary injunction hearing will be held via Zoom on September 23, 2020, at 9:30 am. The Court grants Plaintiffs' counsel request to limit the hearing to a preliminary injunction and vacates the portion of its September 9, 2020 Order that consolidates Plaintiffs' motion for preliminary injunction and permanent injunction.
