On August 3, 2020, the National Association for the Deaf and five plaintiffs who were deaf and used American Sign Language (ASL) as their primary and preferred language brought this action in the U.S. District Court for the District of Columbia against President Trump and other members of the White House staff. Following the onset of the Covid-19 pandemic, the White House began holding televised briefings with the White House Coronavirus Task Force. The briefings did not include in-frame ASL interpretation, the approach adopted by many governors in their own Covid-19 briefings. The plaintiffs sued President Trump and other members of the White House alleging that the defendants' failure to provide in-frame ASL interpretation constituted a violation of the Rehabilitation Act of 1973 and the First Amendment. The plaintiffs sought preliminary and permanent injunctive relief and declaratory relief.

The case was assigned to District Court Judge James E. Boasberg. On September 9, 2020, Judge Boasberg signed an order granting the plaintiffs' motion for preliminary relief. 2020 WL 5411171. The order was stayed until the parties conferred regarding the proper remedy. The parties reached general agreement on the conditions of the injunction, and on September 23, 2020, Judge Boasberg issued an order defining the scope of the preliminary injunction. 2020 WL 5757463. Under the preliminary injunction, defendants were required to include a qualified ASL interpreter in the White House Communications Agency feed for all White House Coronavirus briefings. The interpretation was required to either take the form of an in-frame interpretation by an interpreter near the speaker or a simultaneous stream with an interpreter from a remote location in a picture-in-picture format (PIP). If the defendants used the PIP approach, they were required to make that video feed available to television networks so that they can use the ASL interpretation in their own broadcasts.

Following the court's order of a preliminary injunction, the defendants appealed to the D.C. Circuit and moved to stay district court proceedings until the appeal was resolved. Judge Boasberg ordered a stay on all further proceedings pending the resolution of the defendants' appeal. On March 17, 2021, however, the new Biden-Harris administration filed a motion to dismiss the appeal voluntarily, which was granted by the court five days later. The parties engaged in settlement talks throughout 2021.

The parties reached a settlement agreement and filed a joint stipulation of dismissal with prejudice on December 16, 2021 and Judge Boasberg promptly issued an order dismissing the case. The settlement agreement acknowledged that the Biden-Harris administration had issued a memorandum entitled "Communication Services for People Who Are Deaf or Hard of Hearing at Presidential Briefings" in April of 2021, which set forth a new policy regarding the provision of ASL interpreters and closed captioning services at White House Briefings. The policy stated that the Executive Office of the President would provide a qualified ASL interpreter at:

(1) "Briefings conducted by the President, Vice President, First Lady, Second Gentleman, or White House Press Secretary, for which the White House Press Office or the White House Office of the Press Secretary provide public notice of their occurrence before the event commences and that are captured by the White House Communications Agency (WHCA);"

(2) "Briefings held to address the coronavirus pandemic, including updates regarding the spread of COVID-19, the federal government's response to the pandemic, and vaccinations or treatments;" and

(3) "Any other briefings as approved by the White House Press Secretary or designee, Director of the Office of Administration (OA) and Director of the Office of Management and Administration, or designee(s)."

The policy provided for picture-in-picture (PIP) format with a minimum width of 33% of the full width of the screen if the interpreter was to be filmed in a remote location and required the White House to provide the video feed of the interpreter to television networks and WH.gov and to include the feed in videos uploaded to the White House's social media pages. It also required the White House to upload a video feed including closed captioning to WH.gov and the White House's pages on Facebook and YouTube within approximately 24 hours of the briefing.

The plaintiffs agreed that the policy was consistent with the relief they sought in their complaint. In addition to the policy change, the defendants agreed to pay attorney's fees, expenses, and costs in the amount of $225,000.
