COVID-19 Summary: This is a habeas action brought by immigration detainees in the Otay Mesa Detention Center, seeking release due to COVID-19. The plaintiffs' request for preliminary injunction was denied on June 7, 2020.


On April 25, 2020 immigration detainees held in the Otay Mesa Detention Center (OMDC) brought this lawsuit in the U.S. District Court for the Southern District of California. Represented by the ACLU of San Diego, the National Immigration Project of the National Lawyers' Guild, and private counsel, the plaintiffs brought this action against the OMDC under 28 U.S.C. § 2241 (the federal habeas statute), for violations of their Fifth Amendment due process rights and their Eighth Amendment right to be free from cruel and unusual punishment. Specifically, they alleged that OMDC was unable to comply with public health guidelines and could not provide safety for them in light of COVID-19 without a significant reduction in population at the detention center. The case was assigned to Judge Anthony J Battaglia and Magistrate Judge Bernard G. Skomal, however, the case was marked as related to several other cases in the Southern District and as a result, on April 27, the case was reassigned to Judge Dana M. Sabraw and Magistrate Judge Allison H. Goddard.

Simultaneous with their habeas petition, the plaintiffs filed a motion for temporary restraining order and a motion to certify the class. They sought to certify various classes and subclasses, including:
  • Pretrial Class: All current and future persons in pretrial detention at OMDC;
  • Pretrial Medically Vulnerable Subclass: All current and future people detained pretrial ad OMDC who are aged 45 years or older or who have medical conditions that place them at heightened risk of severe illness or death from COVID-19;
  • Post-Conviction Class: All current and future persons in post-conviction detention at OMDC
  • Post-Conviction Medically Vulnerable Subclass: All current and future people detained post-conviction at OMDC who are aged 45 years or older or who have medical conditions that place them at heightened risk of severe illness or death from COVID-19.
On April 29, the defendants filed a motion to stay the motion to certify class and on May 1, they filed a motion opposing the temporary restraining order. The court granted the motion to stay briefing on class certification May 1.

On May 9, Judge Sabraw denied the motion for temporary restraining order, stating that the Prison Litigation Reform Act (PLRA) barred the court from granting the requested relief because the plaintiffs were requesting a "prisoner release order" and had not met the PLRA's requirements. 2020 WL 2315807 (Amended on May 12 - 2020 WL 3053646).

On May 15, the plaintiffs filed a motion for provisional class certification, seeking to certify the medically vulnerable subclasses and motion for a preliminary injunction ordering the release, enlargement, and/or transfer to home confinement of those within the subclasses.

On June 7, the court denied the preliminary injunction, reaffirming its conclusion that the PLRA applied to the case and restricted the court from offering the plaintiffs the relief they sought. 2020 WL 3053193.

The case is ongoing.
