On September 5, 2019, the Black Parallel School Board and three students in the Sacramento City Unified School District (SCUSD) filed this putative class action in the United States District Court for the Eastern District of California. The plaintiffs sued SCUSD and a selection of its officers under Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act (ADA), 42 U.S.C. § 1983, Title VI of the Civil Rights Act of 1964 (Title VI), and state law. Represented by Disability Rights California, the National Center for Youth Law, Western Center on Law and Poverty, and the Equal Justice Society, the plaintiffs sought injunctive and declaratory relief, as well as attorneys' fees. Specifically, they asked the court to order SCUSD to reform its policies and procedures to identify, offer, and provide accommodations and modifications to all eligible students. The case was assigned to District Judge Troy L. Nunley.

The plaintiffs claimed that SCUSD created and perpetuated an unlawful school system that resulted in modern-day segregation and mistreatment of students with disabilities— particularly Black students with disabilities. The plaintiffs alleged that students with disabilities faced excessive and exclusionary discipline and did not receive accommodations that would allow them to participate in equal education opportunities in violation of the ADA and the Rehabilitation Act. The plaintiffs also alleged that approximately half of students with disabilities were segregated into separate classrooms, equivalent to a status-based denial of equal education, in violation of the Fourteenth Amendment. The plaintiffs further alleged that Black students with disabilities were 2.8 times more likely to face suspension than other students with disabilities, and faced a racially hostile environment, in violation of Title VI of the Civil Rights Act and California Government Code Section 11135. 

In 2017, the Council of Great City Schools—a coalition of 75 of the nation’s largest urban public school systems—had released a report regarding the inadequate special education accommodations in the SCUSD. In 2018, nonprofit advocacy groups expressed their disappointment regarding SCUSD’s continuing failures and demanded immediate action. In their complaint, the plaintiffs asserted that SCUSD had been notified of its discriminatory conduct through the 2017 report, but had not taken effective steps to rectify the problems.

On December 19, 2019, the parties jointly moved to stay proceedings in order to pursue settlement talks. The following day, Judge Nunley signed an order temporarily staying the action for seven months, as requested by the parties. After a number of additional joint motions to stay, the court extended the stay until October 3, 2022 to enable the parties to focus on settlement efforts.

The case was reassigned to Judge Dale A. Drozd in August of 2022.

The following month, on September 26, the parties again submitted a joint stipulation and joint motion for stay to allow settlement talks to continue, citing important progress to date. Judge Drozd granted the joint motion and extended the stay through November 18, 2022. The court ultimately stayed the case until July of 2023.

In April of 2023, the case was reassigned to Judge Daniel J. Calabretta, who had recently been appointed to the federal bench.

A month later, the parties notified the court that they had settled. Under the settlement agreement, an independent monitor would create a plan to achieve the outcomes in the settlement agreement and evaluate whether the district complied with the plan. These intended outcomes included, among other things, a reduction in disciplinary referrals of students with disabilities and Black students with disabilities, more integrated classrooms for students with disabilities and Black students with disabilities, systems to prevent the bullying of students with disabilities and Black students with disabilities, more appropriate special education assessments, and the creation of best practices for issues surrounding IEPs. The defendants also agreed to pay $687,969.10 in attorneys' fees and costs. The court would retain jurisdiction for five years for monitoring purposes.

On May 26, 2023, the court dismissed the case without prejudice, but retained jurisdiction. As of October 2023, the case was ongoing.
