On May 8, 2019, six prisoners with mental and/or physical disorders of the Florida Department of Corrections filed a class-action lawsuit in the U.S. District Court for the Northern District of Florida. The plaintiffs sued the Florida Department of Corrections and its Secretary under 42 U.S.C. § 1983, the Americans with Disabilities Act, and Section 504 of the Rehabilitation Act. The plaintiffs, represented by the Southern Poverty Law Center, Florida Legal Services, and Florida Justice Institute, sought attorneys’ fees and injunctive and declaratory relief, claiming violations of the Eighth Amendment and Fourteenth Amendment. The plaintiffs alleged that the Florida Department of Corrections had frequently, unnecessarily, and harmfully used solitary confinement against prisoners, including prisoners with intellectual or physical disabilities while aware of the heightened risk solitary confinement places on such individuals. On July 2, 2019, those six prisoners submitted an amended complaint adding a seventh plaintiff. The case was assigned to Chief Judge Mark E. Walker.

The defendants moved to dismiss the majority of the on August 6, 2019. They argued that the plaintiffs had not exhausted their administrative remedies, failed to demonstrate standing, and failed to comply with Rule 8(a)(2) of the Federal Rules of Civil Procedure. On October 24, 2019, District Judge Mark E. Walker denied defendants' motion to dismiss.

The lawsuit is ongoing.
