In 2018, President Trump had repeatedly requested Congress appropriate $5.7 billion for the construction of a wall along the southern border, but Congress repeatedly rejected this request. On February 14, 2019, Congress finally reached an agreement on this matter and appropriated $1.375 billion for the construction of a strip of fencing along the border. The following day, President Trump signed this appropriations bill but simultaneously invoked his authority under the National Emergencies Act (NEA). Pursuant to this authority, President Trump declared the situation at the border a national emergency and subsequently ordered that $6.7 billion Congress previously appropriated for other military projects be redirected toward the construction of his proposed border wall. Some of this $6.7 billion was appropriated to the states for the operation of their national guard units, law enforcement programs, and construction projects at their military bases.

On February 18, 2019, sixteen states ("plaintiff states") who would be harmed by this redirection of funding filed a lawsuit against President Trump, the United States, and several Departments and their respective Secretaries for declaratory and injunctive relief. These states claim that taking the money away would harm public safety and the economic and environmental interests of their citizens.

The plaintiff states are seeking declaratory and injunctive relief against President Trump, the United States, the Department of Defense (DOD) and its Acting Secretary, the Department of Homeland Security (DHS) and its Secretary, The Department of the Treasury and its Secretary, the Department of the Interior and its Acting Secretary, and the Secretaries of the Army, Navy, and Air Force. The crux of the plaintiff states’ argument is that the Constitution grants Congress the sole authority to appropriate funds. While NEA gives the President the authority to redirect funds in times of national emergency, there is no emergency at the southern border. So, the defendants violated the Constitution, statutory authority, and acted ultra vires in declaring a national emergency and redirecting congressionally appropriated funds.

Additionally, two plaintiff states, California and New Mexico, argue that the defendant DHS violated the National Environmental Policy Act (NEPA) because it failed to conduct an environmental impact statement (EIS) concerning the border wall project.

This case is ongoing.
