On October 14, 2011, the United States Department of Education, Office for Civil Rights (OCR) received a complaint alleging that the University of Kansas had discriminated against the complainant on the basis of sex in violation of Title IX of the Education Amendments of 1972. Specifically, the complaint alleged that the university failed to take prompt and appropriate investigative and remedial action in response to a report that complainant, a female student at the university, was sexually assaulted on the university's campus by a university employee.
The university entered into a voluntary Resolution Agreement on May 29, 2012, before OCR closed its investigation. As part of the Agreement, the university was required to revise its policies and procedures to ensure that students are not subject to a hostile environment on the basis of sex, to ensure that all incidents of sexual harassment of which the university has notice were promptly investigated and appropriate disciplinary actions were taken, and to provide all faculty and staff with Title IX training annually. The university also agreed to conduct a climate check to gauge the issue of sexual harassment on campus, and to provide programming to students to ensure that students were aware of the university's prohibition against sex discrimination. The university was also required to provide the individual complainant with a letter detailing its commitment to resolving her complaint, and to affirm its general commitment to a campus climate free from harassment. The university also agreed to report relevant data to OCR, and to ongoing monitoring until the terms of the Resolution Agreement were fulfilled.
