On May 23, 2018 the American Civil Liberties Union of Northern California filed this lawsuit against U.S. Immigration and Customs Enforcement (ICE) under the Freedom of Information Act (FOIA). The ACLU brought suit in the U.S. District Court for Northern California seeking declaratory and injunctive relief. The case was assigned to Magistrate Judge Joseph C. Spero.

Plaintiff requested records relating to defendant’s purchase of two private databases of automated license plate reader (ALPR) data. The complaint stated that “[t]he potential use by ICE of data for civil immigration enforcement, an entirely different purpose for which it was originally collected by local police—local criminal investigations—has generated widespread media interest and public concern.” The complaint maintained that access to information about ICE’s use of ALPR databases was necessary to inform meaningful public debate over the scope of government conduct.”

According to the complaint, plaintiff submitted FOIA requests on March 19, 2018 and March 21, 2018, and at time of this suit was filed had received none of the requested information. Defendant filed an answer on July 20, 2018 acknowledging receipt of the FOIA requests and its lack of response at the time of the complaint. But, the answer stated that on or about July 13, 2018, ICE had made an interim release of records in response to the FOIA requests and requesting dismissal of the case.

On August 16, 2018, the parties filed a statement agreeing that the remainder of the requested documents would be released on a rolling basis through November 2018, and with an appended proposed schedule for summary judgement in the event that the dispute cannot be resolved. The case is ongoing as of October 2018.
