On October 31, 2017, the Human Rights Defense Center (HRDC) filed this lawsuit in the U.S. District Court for the Southern District of Ohio. The HRDC sued Greene County under 42 U.S.C. § 1983. HRDC sought declaratory and injunctive relief as well as monetary damages and attorneys’ fees. They claimed that the defendant violated the First and Fourteenth Amendment rights of inmates at the Greene County Jail (GCJ) in their censorship of mail sent from HRDC and other publishers to prisoners at the GCJ. This case was referred to Judge Thomas M. Rose.

On the same day, HRDC filed a motion for preliminary injunction, requesting that the Judge Rose prohibit the defendants from arbitrarily censoring plaintiff’s materials sent to prisoners housed in the GCJ. The plaintiff also requested that the court require the defendants to provide HRDC notice stating the reasons for any rejection of HRDC’s publications and an opportunity to be heard on the matter before finally rejecting any mail sent by HRDC. The plaintiff argued that their publications posed no threat to the safety and security of the facility and that the defendant’s policies and practices did not advance a legitimate penological objective.

On March 7, 2018, Judge Rose ordered the parties to take part in a court conducted mediation supervised by Magistrate Judge Sharon L. Ovington. This case is ongoing. As of May 24, 2018, the court has not ruled on the HRDC’s motion for preliminary injunction.
