They alleged that (1) the City failed to conduct an inquiry into whether the plaintiffs were able to pay their fines before jailing them, in violation of the Fourteenth Amendment’s Equal Protection and Due Process Clauses; (2) the City failed to provide the plaintiffs with legal counsel during the proceedings leading to their incarceration, in violation of the Sixth and Fourteenth Amendments; (3) the City jailed the plaintiffs indefinitely and without an adequate legal process through which they could challenge their detention, in violation of the Due Process Clause; (4) the squalid and unhealthy conditions of Ferguson's jail constituted cruel and unusual punishment, in violation of the Eighth and Fourteenth Amendments; (5) the City used jail time and the threat of jail time to deny the plaintiffs the substantive and procedural protections that Missouri debtors would have against private creditors, in violation of the Equal Protection Clause; (6) the City issued arrest warrants against impoverished persons for failure to pay traffic fines without any finding of probable cause, in violation of the Fourth and Fourteenth Amendments; and (7) the City violated the Fourth and Fourteenth Amendments by detaining the plaintiffs for extended periods without a valid warrant or government interest. 

Represented by ArchCity Defenders, the Civil Rights Corps, Equal Justice Under Law, lawyers from St. Louis University School of Law, and private counsel, the plaintiffs brought suit under 42 U.S.C. § 1983 and 28 U.S.C. § 2201. They sought class action certification, declaratory and injunctive relief, damages, and attorneys’ fees and costs. The case was assigned to Judge Audrey G. Fleissig.

On May 26, 2015, the court partially granted the City’s motion to dismiss, dismissing claims (5) and (6). However, the court granted the plaintiffs’ motion for reconsideration on July 13, 2015, reversing the May 26 order.

On January 29, 2016, the court instructed the parties to undergo mediation. On May 10, 2016, the parties reported that they could not reach a settlement.

On April 13, 2016, the plaintiffs filed an amended class action complaint. The City filed a partial motion to dismiss the amended complaint two weeks later, which the court denied on November 15, 2016.

Plaintiffs sought class certification again in June 2017 and simultaneously moved to disqualify the City’s counsel due to a conflict of interest. On August 7, 2017, the court granted the motion to disqualify counsel and extended a stay on the issue of class certification. According to ProPublica, the firm was disqualified because it hired a lawyer who had previously represented one of the plaintiffs while working for ArchCity Defenders. The court denied class certification on January 29, 2018 without prejudice.

Once the City obtained replacement counsel in September, it moved to dismiss Counts 1, 2, 3, 5, and 6 for lack of subject matter jurisdiction and Count 7 on grounds of sovereign immunity. The court denied the City’s motion to dismiss on February 13, 2018. On February 15, the City appealed the court’s decision with respect to the sovereign immunity claim to the U.S. Court of Appeals for the Eighth Circuit. 

Also on February 15, 2018, the City moved to stay the proceedings pending appeal. The court granted the stay on March 12, 2018. 

On January 10, 2019, Eighth Circuit Judges Steven Colloton, Raymond Gruender, and L. Steven Grasz dismissed the appeal for lack of jurisdiction. The Eight Circuit explained that the City was not itself entitled to sovereign immunity and could not invoke the state's sovereign immunity to justify dismissing the suit. 913 F.3d 757. The district court lifted the stay on that same day and litigation resumed.

The City filed a motion to dismiss Counts 1, 2, 3, 5, 6, and 7 on March 5, 2019. The court denied the motion on August 6, 2019. Judge Fleissig found that the state municipal court was not a required party whose absence (here due to sovereign immunity) required dismissal. 2019 WL 3577529. Later that month, on August 28, the defendant appealed this order to the Eighth Circuit. The defendant filed a motion to stay proceedings pending appeal the following day. The district court denied this motion on September 19, 2019, and discovery continued. On October 10, 2019, the Eighth Circuit dismissed the appeal for lack of jurisdiction without explanation. 2019 WL 8194959.

The City filed a petition for a writ of certiorari with the Supreme Court of the United States on February 13, 2020, appealing the Eighth Circuit’s October 10 decision. The Supreme Court declined to hear the case on March 23, 2020. 140 S. Ct. 2515.

Discovery continued in the district court throughout 2020 and 2021. On November 19, 2021, the plaintiffs moved to certify the following six classes:

  1. A Bearden Class consisting of all persons who have, at any time since February 8, 2010, been kept in jail by the City of Ferguson for failing to pay a fine, fee, bond, surcharge, or cost, without an inquiry into their ability to pay (Count One).
  2. A Gerstein Class consisting of all persons who have, at any time since February 8, 2010, been held in jail by the City of Ferguson after a warrantless arrest for longer than a reasonable period of time (48 hours at a maximum or such shorter period of time as the Court may determine) prior to a finding of probable cause by a neutral magistrate for their arrest and continued detention (Count Seven).
  3. A Jail-Conditions Class consisting of all persons who, at any time since February 8, 2010, were held in the City of Ferguson jail (Count Four).
  4. A Warrant Class consisting of all persons who have, at any time since February 9, 2010, been held in jail by the City of Ferguson after being arrested on a warrant issued by the City (Count Three).
  5. A Post-Judgment Class consisting of all persons who have, at any time since February 8, 2010, been jailed by the City of Ferguson because of their non-payment in connection with a prior judgment (Counts Two, Five, and Six).
  6. A Declaratory and Injunctive Class consisting of all persons who currently owe or who will incur debts to the City of Ferguson from fines, fees, costs, or surcharges arising from judgments in cases prosecuted by the City (Counts Two, Five, and Six).

The court dealt with discovery disputes regarding expert testimony and sealed documents throughout 2022. 

After a hearing on May 24, 2022, the court granted class certification for the plaintiffs on June 9, 2022. The City filed a petition to appeal the class certification order on June 23, 2022, which the Eighth Circuit denied on July 18, 2022. 

On August 18, 2022, the parties asked the court to enter a stipulated order. The parties agreed that the certified classes should end on September 30, 2017 (the date on which the Ferguson jail closed), and that the plaintiffs would voluntarily dismiss their claims for declaratory and injunctive relief. The next day, Judge Fleissig approved the end date for the Bearden, modified Gerstein, Warrant, and Post-Judgment Classes, but not for the Jail Conditions Class. The court also ordered the parties to confer regarding the application of Federal Rule of Civil Procedure 23(e) to the proposed voluntary dismissal. On December 30, 2022, the court imposed an end-date of September 30, 2017 for the Jail Conditions class.

The court referred the case to mediation on September 1, 2022. Judge Fleissig also preliminarily approved the plaintiffs’ voluntary dismissal of their claims for declaratory and injunctive relief on September 13, 2022. 

On November 15, 2022 the neutral mediator reported that although the parties participated in good faith, they did not reach a settlement agreement.

The court granted the joint motion for voluntary dismissal of the declaratory and injunctive relief claims on December 30, 2022. Judge Fleissig scheduled a final approval hearing regarding the stipulated voluntary dismissal for July 5, 2023, and a jury trial for November 13, 2023.

The parties cross-moved for summary judgment on March 13, 2023. 

On May 12, 2023, the parties jointly moved for final approval of the dismissal of the declaratory and injunctive relief claims. After more mediation, the parties reached a resolution in principle on May 31, 2023. 

Upon notice that the parties had reached an agreement in principle, the court stayed the proceedings on June 30, 2023, except the final approval hearing regarding the voluntary dismissal of the declaratory and injunctive relief claims.  

After a motion hearing on July 5, the court granted the parties’ request to dismiss the declaratory and injunctive relief claims on July 18, 2023. 

On December 14, 2023, the parties advised the court that they would submit a joint motion for preliminary approval of a settlement agreement by January 17, 2024. The case is ongoing as of December 31, 2023.
