This is a 2014-2015 lawsuit about the right of same-sex couples in Wyoming to marry in Wyoming and have their out-of-state same-sex marriages recognized in Wyoming.

On October 7, 2014, four same-sex couples and Wyoming Equality filed a lawsuit in the United States District Court for the District of Wyoming under 42 U.S.C § 1983 against Wyoming. The four couples lived in Wyoming: two sought to get married in Wyoming and the others sought to have their marriages, performed in other jurisdictions, legally recognized in Wyoming. Wyoming Equality is a non-profit organization that works on behalf of LGBT causes in the state. The four couples and Wyoming Equality were collectively represented by three private law offices and by The National Center for Lesbian Rights.

The plaintiffs sought to preliminarily and permanently halt Wyoming from enforcing Wyoming Statute 20-1-101, which denied marriage licenses to same-sex couples and forbade the recognition of same-sex marriages performed elsewhere, and they sought to enjoin any other sources of state law, policy, or practice that exclude same-sex marriage or that refuse recognition of out-of-state same-sex marries. The plaintiffs argued that by defining marriage as only between a man and a woman, the law deprived same-sex couples of the right to due process and the equal protection of the laws in violation of the Fourteenth Amendment of the United States Constitution. In addition, the plaintiffs argued that the law must be overturned in light of the Tenth Circuit (to which Wyoming belongs)'s decisions in Kitchen v. Herbert and Bishop v. Smith, which both held that laws banning same-sex marriage are unconstitutional. The plaintiffs also sought the costs, expenses, and attorneys' fees related to the lawsuit under 42 U.S.C. § 1988.

On October 17, 2014, Judge Scott W. Skavdahl for the U.S. District Court entered an order preliminarily enjoining the enforcement of Wyoming Statute 20-1-101, ruling that Kitchen and Bishop controlled the outcome of the lawsuit. Judge Skavdahl found that Wyoming's ban on same-sex marriage did violate the couples' rights under the Fourteenth Amendment. However, in order to allow time for the Defendants time to appeal Kitchen and Bishop in the Tenth Circuit, the Judge also temporarily stayed the preliminary injunction until October 23, 2014, or until the Defendants filed a notice that they would not appeal.

Wyoming decided not to appeal the lawsuit to the United States Court of Appeals for the Tenth Circuit and on January 29, 2015, Judge Skavdahl entered an order permanently enjoining Wyoming from enforcing statute 20-1-101.

On April 9, 2015, Judge Skavdahl granted in part the plaintiffs' motion for attorneys' fees, ordering Wyoming to pay $58,967.83 of attorneys' fees, out of the $92.728.07 the plaintiffs requested. The last action in the lawsuit was on June 16, 2015, when the Court received one of many payments for said attorney's fees.

(TEXT-ONLY) ORDER by the Honorable Scott W Skavdahl; The Court is in receipt of a check from Laramie County in the amount of $20.96, which the County asserts constitutes its share of costs that were previously ordered by the Court Docket entries 83 & 84 . The Court does not know how the County came to this calculation as the Court did not break down the order of costs by defendant. The Clerk of Court for the District of Wyoming shall return the amount of $20.96 to Laramie County. Laramie County should coordinate with the other parties to determine how the order of costs should be split and paid. Laramie County shall send the appropriate amount directly to the respective plaintiffs' attorney(s), not to this Court. If desired, Laramie County can file a Notice of Compliance after it pays the order of costs to serve as record of payment.(Court Staff, stbd) (Entered: 06/02/2015)
