In 2014, the United States Attorney's Office for the Eastern District of Michigan opened an investigation of the Campus Inn Hotel in Ann Arbor, MI, pursuant to the Americans with Disabilities Act. The USAO had received a complaint from someone alleging that he was unable to stay at the hotel with his son, who has a physical disability, because the hotel didn't have any accessible guest rooms. The investigation later expanded to another Ann Arbor hotel, which is part of a joint venture with the Campus Inn.
The investigation resulted in a June 3, 2014, Settlement Agreement between the hotels and the U.S. Government. As part of the agreement, the hotels committed to modify a number of guest rooms, with at least one in each price/amenity category, so that they are "limited accessible." The hotels also agreed to modify their public restrooms, lobbies, and elevators. They agreed to make these changes as soon as practicable, and to complete the restroom modifications within a year of the agreement's effective date, and the balance of the construction within six months of the agreement date. They also agreed to train their employees on the site modifications and accommodation of disabled guests.
In return, the USAO agreed not to sue the hotels under the ADA. However, the government retained the right to inspect the hotels in order to enforce the agreement, and if it found the hotels to be in noncompliance, to later sue them.
The agreement will remain in effect for three years after the effective date.
