This case was brought by the Prison Legal News (PLN) on behalf of prisoners and pre-trial detainees held in custody at Ventura County jails. PLN provides a monthly journal, informational brochures, and paperback books that all discuss issues involving the criminal justice system.

PLN alleged that the Ventura County jails' mail policies and practices unconstitutionally restrict PLN's correspondence with inmates. More specifically, PLN argued that the Ventura County jails' mail policies lacked clarity, failed to provide adequate notice to PLN, and did not give PLN the opportunity to challenge their policy as censorship.

This case arose after PLN made numerous attempts to contact inmates at Ventura County jails. PLN mailed materials to inmates held at Ventura County jails starting in February 2012, only for the materials to be returned to sender due to "suggestive" or "unacceptable ads inside." After further research, PLN discovered that Ventura County revised their written mail policies to specifically exclude PLN's materials from being delivered to inmates. The jail also had a postcard-only policy, under which postcards were the only acceptable form of incoming mail.

In February 2013, PLN filed a state tort claim against the defendant, but the defendant continued to exclude PLN's materials from being delivered to inmates irregardless of PLN's legal actions.

On January 31, 2014, PLN filed a complaint in the U.S. District Court for the Central District of California under 42 U.S.C. §1983 arguing that the defendant's actions violated the inmates' First and Fourteenth Amendment rights. Represented by Rosen, Bien, Galvan & Grunfeld, plaintiff asked for declaratory, injunctive, and monetary relief. On June 16, 2014, Judge George H. King granted plaintiff's motion for a preliminary injunction and ordered defendants to suspend enforcement of their postcard-only policy. The court further ordered defendants to stop refusing to deliver correspondence to inmates on the basis of its subscription content, print medium, or sexually "suggestive" material. The defendants appealed this preliminary injunction to the Ninth Circuit on June 27, 2014.

While the matter was on appeal, the parties entered into settlement negotiations. After several weeks, the parties stipulated to dismiss certain defendants from the case, and on August 22, 2014, Judge King dismissed with prejudice all defendants except for the County of Ventura and the Sheriff of the Ventura County in the sheriff's official capacity.

On August 27, 2014, the plaintiff filed a stipulation for a permanent injunction, and the defendants moved to voluntarily dismiss their appeal pending in the Ninth Circuit. In response, on September 4, 2014, Judge King granted this permanent injunction whereby defendants were ordered to permanently abide by the terms of the earlier preliminary injunction. Additionally, defendants were ordered to not prohibit inmates from ordering books, magazines, and other publications. Finally, defendants were required to implement training procedures for mailroom staff and conduct annual legal updates. Additionally, as part of the settlement agreement, the county agreed to pay Prison Legal News $350,000 for damages, costs and fees.

Instead of continued monitoring by the court, Judge King ordered that the plaintiff was to notify the defendants of any violation of the injunction whereby a magistrate judge would determine any contested matters in binding arbitration. However, the court maintained jurisdiction over the settlement agreement until defendants file a motion to terminate, sometime after July 31, 2017. As of November 26, 2017, no further actions have been taken by either party, and so the case is presumably closed.

King: This matter is before us on Plaintiff's Motion for Preliminary Injunction ("Motion"). We have considered the papers filed in support of and in opposition to the Motion and the Parties' arguments at the May 14 hearing. We have also considered Defendants' supplemental opposition and Plaintiff's response, which we granted the Parties leave to file after the May 14 hearing. [Dkt. No. 37]. As the Parties are familiar with the facts, we will repeat them only as necessary. Accordingly, we rule as follows: Plaintiff's Motion is GRANTED in full. We exercise our discretion to waive the bond requirement in light of PLN's limited financial resources. See Save Our Sonoran, Inc. v. Flowers, 408 F.3d.11113, 1126 (9th Cir.2004). Pending final resolution of this litigation, Defendant SHALL suspend enforcement of the postcard-only policy for incoming mail within 21 days hereof. Defendants SHALL forthwith give senders of rejected mail written notice and an opportunity to appeal the rejection decision, and SHALL not reject mail for containing "suggestive" content, Xeroxed material, or subscription order forms. Within 7 days hereof, PLN SHALL propose a suitable preliminary injunction incorporating this Order. ORDER by Judge George H. King: GRANTING PLAINTIFF'S MOTION FOR PRELIMINARY INJUNCTION. IT IS ORDERED that Defendant County of Ventura and individual Defendants, DEAN, PENTIS, OKSNER and BARRIOS and their successors, officers, agents, employees, and all others in active concert or participation with them who receive actual notice of this injunction by personal service or otherwise SHALL suspend enforcement of the postcard-only policy for incoming mail no later than June 19,2014. Defendants shall not refuse to deliver correspondence sent to inmates at the County's jails on the ground that correspondence is not written on a postcard. IT IS FURTHER ORDERED that Defendants SHALL not refuse to deliver correspondence, catalogs or subscription orders or other materials. IT IS FURTHER ORDERED that Defendants SHALL NOT refuse to deliver correspondence to inmates at the Jail on the basis that the materials were Xeroxed, photocopied or printed from the internet. IT IS FURTHER ORDERED that Defendants SHALL NOT refuse to deliver copies of publications from Plaintiff or other publishers on account of sexually "suggestive" content unless the publication contains actual nudity or graphic depictions of sexual acts. IT IS FURTHER ORDERED that Defendants shall provide written notice an administrative appeal process to senders and inmates when Defendants refuse to deliver publications and correspondence to inmates at the County's jails. Within 30 days if the issuance of this order, the parties shall confer regarding the specific policy, procedure and forms for providing notice and an appeal process. All named and fictitious defendants are hereby dismissed with prejudiceas to any state or federal cause of action in any state or federal court, including any claim for legal and/or equitable relief, except as otherwise provided herein. 2. These named defendants being dismissed with prejudice are Geoff Dean, in his individual capacity only, Gary Pentis, Rick Barrios, and Linda Oksner, in their personal, individual and official capacities.3. Each side is to fully and permanently bear all of its and their own past,present, and future attorneys fees and ordinary and expert costs, with the single exception of future fees and costs relating to monitoring, more clearly described in the order approving the stipulated permanent injunction.4. PERMANENT INJUNCTION filed by Judge George H. King. IT IS HEREBY ORDERED that the Sheriff of Ventura County (the Sheriff), and Defendant County of Ventura (the County) and their successors, officers, agents, servants, employees, and attorneys, and all others in active concert or participation with them who receive actual notice of this injunction by personal service or otherwise (hereinafter referred to collectively as Defendants), SHALL NOT refuse to deliver correspondence to or from inmates at the Countys jails on the ground that correspondence is not written on a postcard. IT IS FURTHER ORDERED that Defendants SHALL implement and abide by the policy for incoming mail (attached hereto as Exhibit B) within thirty (30) days of the date of the entry of this ORDER. Ventura County Sheriffs Office, Detention Services Division, SHALL conduct a four (4) hour training block in order to adequately familiarize all mailroom staff persons with the provisions of the attached mail policy and will thereafter conduct two (2) hour annual legal updates. Defendants SHALL NOT refuse to deliver correspondence, catalogs or subscription order forms to inmates at the Jail on the basis that inmates cannot order subscriptions or other reading materials. IT IS FURTHER ORDERED that the monitoring and compliance procedures described herein shall continue until this Permanent Injunction is terminated. During the pendency of this Injunction, Plaintiff shall not file new actions in this Court or in any other Federal orState Court against Defendants, including those who have been dismissed,concerning any matter prohibited or mandated by the provisions of this injunction. Defendants shall file a motion to terminate this Order no earlier than July 31, 2017, upon demonstration of substantial compliance with the terms of this Order within the calendar year preceding the filing of the motion and shall notify Plaintiff, in writing, of their intent to do so no laterthan thirty (30) days prior to filing any such motion.
