On October 2, 2001, Arc/Connectibut (a non-profit advocacy organization) and ten individual plaintiffs filed a lawsuit under the Medicaid statute, the Americans with Disabilities Act, and the U. S. Constitution, against various state officials in the United States District Court for the District of Connecticut. Plaintiffs, represented by private counsel, asked the court for declaratory and injunctive relief, claiming that their rights had been violated. Specifically, Plaintiffs claimed that the state failed to provide adequate services under the waiver, failed to provide them with a choice between institutional and home and community-based services, failing to provide services in a reasonably prompt manner, and failing to provide services in the most integrated setting appropriate to their needs.

On August 20, 2002, the Court (Judge Janet B. Aterton) granted Plaintiffs' motion to amend their complaint and that fifteen additional disabled individuals would be allowed to intervene in the action. ARC/Connecticut v. O'Meara, 2002 WL 31106383 (D. Conn. Aug. 20, 2002).

The parties reached a settlement agreement, and on March 31, 2005, the Court issued an order of dismissal notifying the parties that the case was being administratively closed pending the completion of notice to class members following the Connecticut General Assembly's approval of the parties' settlement agreement.

The Court (Magistrate Judge Joan G. Margolis) preliminarily approved the settlement on April 1, 2005. The Court also entered various orders relating to class notice and the process by which the Court will make a final determination as to whether the settlement agreement will obtain final approval.

The Court approved the settlement agreement during a fairness hearing on May 20, 2005 and dismissed the case on May 31, 2005. The Court retained jurisdiction for enforcement purposes. The case was closed, and there has been no additional substantive litigation.
