On September 24, 1997, a group of African American employees filed a lawsuit, under 42 U.S.C. § 1981 and 1981(a) and the Missouri Statute §213.111, R.S.Mo., against the St. Charles Riverfront Station, Inc. The plaintiffs, represented by private counsel, claimed that they were victims of racial discrimination when they were denied employment, promotions, and were subjected to a hostile environment and unfair discipline and discharge policies by the defendant.

The plaintiffs filed First and Second Amended Complaints on October 8, 1997 and January 22, 1998 respectively. On March 10, 1998, the plaintiffs moved to certify the class. The Court (Hon. Rodney W. Sippel) scheduled a Class Certification Hearing for August 25-26, 1998. After much deliberation, the court ordered the parties to file a Joint Stipulation of Proposed Settlement on June 8, 1999. The court preliminarily approved a Proposed Class Action Settlement and order on July 16, 1999, and granted final judgment on October 18, 1999, resulting in monetary and injunctive relief.
