An individual opted out of a settlement class in an earlier gender discrimination action against Metropolitan Life Insurance Company. She
filed her individual complaint on December 31, 2003. That case appears in the Civil Rights Litigation Clearinghouse Database as EE-NY-255. In the class action suit, the parties agreed to a consent decree of three years duration. MetLife paid $5m in damages, $3.4m in attorneys' fees and costs, and agreed to a number of changes in policy at the company.
On November 2, 2004, in an unpublished order, the court resolved some discovery disputes. Mitchell v. Metro. Life Ins. Co., No 02-10294, 2004 WL2439704 (S.D.N.Y. Nov. 2, 2004). The docket notes an Order of Discontinuance on January 24, 2005, noting that the action "has been or will be settled." The last entry on the docket, on April 29, 2005, indicates a dismissal by stipulation. Neither the complaint nor settlement agreement are publicly available.
