On January 17, 2001, the EEOC filed a charge against Palm Management Corp., which manages The Palm Restaurants, alleging that the company violated Title VII of the Civil Rights Act of 1964 by failing to recruit and hire women into service worker positions.

On December 17, 2003, the EEOC announced resolution of the charge, "ending a nationwide investigation focusing on past recruitment and hiring practices." The parties entered into a pre-litigation agreement obtained through the EEOC's settlement process. Under the terms of the agreement, the defendant agreed not to discriminate or retaliate against employees; to establish a Class Fund in the amount of $500,000; to engage in workforce monitoring; to provide training addressing discrimination to management; to improve recruitment and hiring of females into service worker positions; and to implement certain record-keeping procedures.

The agreement was to expire either after three years or after distribution of the Class Fund, whichever was later. During that time, the U.S. District Court for the Central District of California had authority to enforce the terms of the agreement.
