On September 17, 2007, the Equal Employment Opportunity Commission (EEOC) filed suit under Sections 706(f)(1) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e-5(f)(1) and Section 102 of the Civil Rights Act of 1991, 42 U.S.C. § 1981a in the U.S. District Court for the Central District of California, on behalf of an aggrieved employee. The EEOC alleged that the defendant discriminated against and subjected the employee to a hostile environment because of her sex. The EEOC sought monetary, injunctive, and declaratory relief.

On June 14, 2008 the District Court (Judge Virginia A. Phillips) approved a settlement between the parties and dismissed the plaintiff's claims. The settlement required the defendant to pay $50,000 to the aggrieved employee to compensate for emotional distress caused by the alleged conduct. The decree generally enjoined the defendant from practicing any future discriminatory conduct. More specifically, it required that the defendant conduct annual training for its human resources personnel concerning issues and policies regarding equal employment, harassment, discrimination, and retaliation. The decree was to remain in effect and monitored over a period of two years.

The decree was entered in June 2008 and scheduled to last until June 2010. No further docket entries exist, so the case is closed.
