On October 13, 2005, an African American man represented by the ACLU filed suit against Connectiv for racial discrimination. The complaint is not available for this case. Information used to write this summary was gathered from the cases with which it was consolidated.

On a motion by the defendant, the court (Judge Gene E.K. Pratter) ordered to consolidate this suit with another set of consolidated actions with similar race discrimination claims on November 18, 2005. The case consolidated with Equal Employment Opportunity Commission v. Conectiv et al. in which the EEOC sued four private corporations: Conectiv; Dellovade, Inc.; Steel Suppliers Erectors, Inc.; and Matrix Services Industrial Contractors (also know as Bogan, Inc./Hake Group. Plaintiffs sued under the Civil Rights Acts of 1964 and 1991 alleging unlawful employment practices on the basis of race. The plaintiffs claimed that the defendants allowed plaintiffs to be subjects to racial harassment in the form of graffiti, racial slurs, and other racist symbols from both managers and coworkers. They alleged that the defendants failed to take prompt measures to correct the racially hostile work environment. The plaintiffs sought injunctive relief compelling defendants to carry out policies that provided equal employment opportunities and monetary damages.

The parties entered into consent decrees (one for each defendant) on May 8, 2008. The consent decrees awarded monetary and injunctive relief. The plaintiff in this case was awarded $187,500 from Connectiv and $225,000 from Bogan/Hake. The settlement did not award costs or attorneys fees. Additionally, Connectiv and the other defendants were enjoined for four years from engaging in employment practices that permitted harassment in violation of Title VII or retaliating against complaints about such employment practices. The defendants agreed to adopt policies against discrimination, harassment, retaliation, and to adopt complaint procedures to report these activities. Further, the defendants agreed to post notice of the consent decree and resulting policies. Finally, the defendants agreed to provide anti-discrimination training for all managers and record and report complaints of harassment to the EEOC.

Aspects of the agreement were appealed by some plaintiffs until they voluntarily dismissed their appeal on December 11, 2008. The agreement entailed court enforcement of the decree for four years. The settlement expired in 2012, and the case is now closed.
