In 1999, attorneys with the Uptown People's Law Center in Chicago filed a class action lawsuit in the Circuit Court for Sangamon County, Illinois, challenging the administrative detention procedures at the Tamms Correctional Center. After the suit was filed, the Illinois Department of Corrections issued a new administrative directive, "Renunciation of Affiliation with Security Threat Groups" ("the Renunciation Policy"), which provided that unless an inmate agreed that he would no longer affiliate with a gang, and provided the Department with all information he has regarding the structure and activities of the gang, he would not be permitted to leave Tamms. Plaintiffs amended their complaint to challenge the Renunciation Policy, which plaintiffs alleged violated procedural and substantive due process and the prohibition against ex post facto laws and self-incrimination as guaranteed by the U.S. and Illinois Constitutions. Plaintiffs further alleged that the policy violated the Illinois Administrative Procedures Act, 5 ILCS 100/5-5 ("The APA") and the Unified Code of Corrections ("the Code"), 730 ILCS 5-1-1-1.
