On March 1, 1999, former employees at Hygrade Food Products (Hygrade) filed this class-action lawsuit in the U.S. District Court for the Eastern District of Pennsylvania. The Plaintiffs sued Hygrade and Sara Lee Corporation under Title VII of the Civil Rights Act of 1964. The Plaintiffs were represented by private attorneys. There is insufficient information on the case that shows what reliefs the Plaintiffs sought. The Plaintiffs alleged that the Defendants engaged in across-the-board racial discrimination against blacks in hiring, promotion and termination, and this created a hostile and abusive work environment. The Plaintiffs also alleged that the Defendants engaged in racial harassment against African American employees with regard to the terms and conditions of their employment, as well as to supervisory or managerial positions, work assignments and discipline. The Plaintiff's factual allegations describe situations in which African American employees were treated differently than similarly situated white employees. The case was assigned to Judge Lowell Reed Jr. Miller v. Hygrade Food Products Corp., 89 F.Supp.2d 643 (E.D.Pa. 2000).

The Plaintiffs moved for class certification in July 1999. However, Judge Reed on November 19, 1999 denied this request. The Plaintiffs nonetheless continued to litigate the case individually, and from November 1999 to October 2001, the parties engaged in discovery.

On October 9, 2001, the Defendants moved for summary judgment. During the next three weeks, the parties presumably discussed a potential settlement agreement. On October 30, 2001, Judge Thomas N. O'Neill Jr. ordered that the Defendants withdraw its motion for summary judgment without prejudice while the settlement discussion is pending.

The parties had a settlement hearing on February 25, 2002. On May 24, 2002, Judge Reed ordered the dismissal of the case with prejudice. Judge Reed also ordered that the transcript of the hearing be sealed and confidential. The contents of the settlement agreement is unavailable from the records. The case closed in 2002.
