On December 6, 2004, a group of African-American police officers brought a lawsuit against their employer, the Baltimore Police Department (BPD), as well as various other municipal entities, including the City of Baltimore and the Baltimore City Council, in the United States District Court for the District of Maryland. The plaintiffs alleged that they had been discriminated against in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e and giving rise to a cause of action under 42 U.S.C. § 1983. Specifically, the plaintiffs contended that the BPD had engaged in a pattern and practice of disparate discipline with respect to African-American police officers, claiming that the excessive subjectivity in the disciplinary process resulted in both unintentional and/or intentional discrimination against African American officers on the basis of their race. The complaint alleged that African American and white officers would commit the same disciplinary offenses, but the African American officers' offenses were rated as more severe and thus they routinely received harsher discipline--including more frequent termination--as a result. The hostile work environment alleged in the complaint included derogatory comments such as the n-word and having dog feces wrapped in an African American-owned newspaper left on officers' desks. Other harassment allegations included nooses in lockers, being assigned to low-level duties to prevent advancement, and superior African American officers having their authority undermined by subordinate white officers.

The case settled on June 18, 2009. In the settlement, Defendants paid $4.5 million. A $2.5 million was funded to pay the individual claims of the 15 plaintiffs set up a $2.5 million fund to pay the individual claims of the 15 plaintiffs. The remaining $2 million was allocated towards addressing the discriminatory culture, including leadership classes, training on the disciplinary process, and hiring a consultant to assist with antidiscrimination efforts.

On October 16, 2013, one of the original plaintiffs, acting pro se, moved for summary judgment for violation of a civil court order in the United States District Court for the District of Maryland, Northern Division against the BPD and the City of Baltimore. Plaintiff alleged a violation of the Settlement Agreement's Confidentiality provision by providing potential employers with the plaintiff's full personnel file. The case was assigned to District Judge William D. Quarles, Jr. 

On November 21, 2013, defendants filed a motion in opposition, arguing that no evidence suggested that BPD violated the settlement agreement and that plaintiff failed to prove a causal connection between BPD’s actions and plaintiff’s inability to procure employment. 

On December 6, 2013, the case was assigned to Magistrate Judge Beth P. Gesner. On August 1, 2014, after settlement conferences proved unsuccessful, Magistrate Judge Gesner issued a report recommending that plaintiff's motion be denied. Magistrate Judge Gesner found that plaintiff signed the Public Safety Release authorizing “full disclosure of all records” almost four years after he signed the Settlement Agreement and, the plaintiff arguably waived the dates of service provision, permitting the BPD to provide full disclosure. Also, the Judge also noted that mentioned the City was not vicariously liable for the BPD's actions.

On September 16, 2014, Judge Quarles adopted Magistrate Judge Gesner’s report and recommendation, denying plaintiff’s motion. The court held that plaintiff had failed to meet his burden of presenting clear and convincing evidence of a knowing violation of the settlement agreement or show resultant harm.

On March 19, 2015, plaintiff filed an appeal in the U.S. Court of Appeals for the Fourth Circuit. 

On March 27, 2015, a panel including Judges Harvie Wilkinson III., Robert B. King, and Stephanie D. Thacker affirmed the district court’s denial of summary judgment for the reasons stated by the district court.
