On January 5, 2001, employees filed a lawsuit under 28 U.S.C. § 1441 of the Class Action Fairness Act of 2005 against the Ford Motor Company in the United States District Court for the Middle District of Tennessee. The plaintiffs, represented by private counsel, asked the court for injunctive relief due to alleged employment discrimination. The plaintiffs sought to represent similarly situated individuals.

According to the PACER docket, on June 19, 2002, prior to certifying a class, the court (Judge Aleta A. Trauger) produced an order stating that the parties had reached a settlement, establishing a settlement class. According to the PACER docket, on November 15, 2002 the parties proposed a settlement order to the court, and on November 20, 2002 the court (Judge Trauger) approved the settlement. Though class certification had not been granted, a settlement class was established in the agreement. With the settlement, the plaintiffs received incentive payments, attorneys' fees and expenses, a total of $60,000. Following the settlement, the defendants submitted progress reports to the court. Shedding light on the injunctive relief provided by the settlement, a monitor's revised proposal for mid-point review dated September 27, 2006, states, "The initiatives instituted by Visteon Corporation focused on the goal of promoting and fostering equal opportunity in compensation, promotion, evaluations, and career advancement for all employees in all levels and areas of the business, regardless of race, color, gender, religion, age, national origin or disability, and to promote and foster an environment of inclusion, respect, and freedom from retaliation."

The defendants continued to file status reports on the settlement through May 2007. No further information is available.

ORDER by Judge Aleta A. Trauger: it appears that the first amended complaint improperly identifies pltfs "Chuquitta and Xavier Sweatt, Administrators of the Estate of Amos Sweatt" (DE #67).
