This summary relates to the racial profiling aspect of the case NAACP, et al v. City of Philadelphia, Case No. 2:96-cv-06045-SD which is in the Clearinghouse as PN-PA-2.

In accordance with the consent decree, Plaintiffs submitted "Plaintiffs' Fifth Monitoring Report - Pedestrian and Car Stop Audit" [the report] on December 7, 2000. The report details an analysis of documents and data relative to PPD stops and arrests.

As set forth in the report, the PPD maintains two separate forms to record initial police activity: (1) the 75-48 form for sight arrests (where an officer observes activity or receives information that constitutes probable cause to arrest) and (2) the new 75-48(a) form for car or pedestrian stops (where there was an insufficient basis at the outset of the officer's interaction with the detainee to justify an arrest, but which in some instances lead to arrest). The use of 75-48(a) was implemented during the course of the consent decree period, in response to recommendations by Plaintiffs' attorneys.

Plaintiffs' attorneys received and reviewed PPD data, including over one thousand 75-48(a)s. Plaintiffs employed the services of Dr. Peter Jones, Associate Professor of Criminal Justice at Temple University to assist in the review. Dr. Jones analyzed the PPD data and reached various statistical conclusions which were contained in the report.

The report concluded that there were many police districts in Philadelphia in which African-Americans were being stopped and detained by police in numbers completely out of proportion to their population, as many as 10 times more than one would expect. Plaintiffs' attorneys recommended some immediate reforms to remedy what they believed was a pattern of continued racial bias by some officers. One such recommendation was for the PPD to computerize the information that is recorded in the 48(a)s to allow PPD supervisors to identify trends of suspect activity.
