On January 8, 1993 The United States Department of Justice (DOJ) filed an employment discrimination lawsuit in the District Court for the Northern District of Texas against the Dallas Area Rapid Transit. We do not have a copy of the Complaint, but from the docket, it appears that the plaintiff claimed race discrimination.
The District Court (Judge Jerry Buchmeyer) approved a consent decree on January 13, 1993. The consent decree enjoined the defendant from retaliating against any person because of that person's opposition to discriminatory policies or filing of an EEOC charge. The defendant was also required to pay an individual employees money damages and offer that employee a position as Manager of Special Projects in the Department of Minority Affairs, grade 9, with retroactive seniority. On January 13, 1993, the court closed the case.
The individual employee intervened alleging that the defendants breached the consent decree. On April 3, 1995, the court denied the plaintiff-intervenor's motion for summary judgment. On November 27, 1995, the district court granted the defendant's motion for summary judgment as to the intervenor's claim for breach of the consent decree.
The plaintiff-intervenor appealed. The Court of Appeals affirmed the District Court's grant of summary judgment in favor of the defendants.
