On December 16, 1993 the United States Department of Justice ("D.O.J.") filed a lawsuit under Title VII, 42 U.S.C. § 2000e, et seq. in the U.S. District Court for the Western District of Tennessee against Tipton County. The D.O.J. alleged that the defendant retaliated against an employee for filing a charge with the EEOC against the Sheriff's Department and later discharged him. The complaint could not be obtained.

On December 28, 1993 a consent decree was approved by the court (Judge Julia S. Gibbons). The consent decree stated: (1) the defendant shall not engage in any act or practice that has the purpose or effect of unlawfully discriminating against any employee with the Tipton County Sheriff's Department because of that individual's participation in any EEOC activity; (2) the defendant shall offer to pay compensatory damages to the plaintiff; (3) the defendant shall offer to expunge their files of any record of the plaintiff's discharge; and (4) the decree shall terminate two years from the day of its entry.
