On December 28, 1993, the U.S. Department of Justice ("D.O.J.") filed a lawsuit in the U.S. District Court for the Northern District of Illinois against the State of Illinois, the City of Aurora, and the Board of Trustees of the City of Aurora Police Pension Fund (the "Fund") under Title I of the Americans with Disabilities Act ("ADA"). The D.O.J. requested declaratory and injunctive relief, alleging that the defendants violated the ADA by excluding police officers and firefighters with certain disabilities from qualifying for pension benefits. Aurora filed a crossclaim against the State and the Fund seeking indemnity and injunctive relief in the event that the court finds Aurora liable for violating the ADA.

On August 30, 1994, the district court (Hon. William T. Hart) granted the State's motion to dismiss the City's crossclaim but denied the State's motion to dismiss the complaint.

On August 9, 1995, the court (Hon. Blanche M. Manning) entered a consent decree, the details of which are not available to us.
