On January 10, 2001 the U.S. Department of Justice ("D.O.J.") filed a lawsuit under Title VII of the Civil Rights Act of 1964 against the Delaware Department of Public Safety and the Delaware State Police in the U.S. District Court for the District of Delaware. The D.O.J. sought monetary for those who suffered from the defendant's allegedly discriminatory behavior and injunctive relief. The D.O.J. specifically requested that the court to order the defendant to refrain from using written examinations as part of its hiring process.

On July 21, 2006, the district court (Judge Kent A. Jordan) approved a consent decree in which the defendant agreed to pay the amount of $1,425,000 to all African-American applicants who met the minimum requirements for the position they applied for and who scored a 66% on their standardized test. The consent decree further provided that defendants would not use a written test that has the purpose or effect of unlawfully discriminating against African Americans.
