On October 27, 2005, the United States Attorney's Office filed a lawsuit against the S.O.G. Specialty Knives Inc. under 38 U.S.C. § 4301, et seq. ("USERRA") in the U.S. District Court for the Western District of Washington. The Department of Justice asked the court for injunctive and monetary relief, alleging that the defendant had violated USERRA, by terminating and refusing to rehire an employee to his original position after taking a military leave of absence.

The plaintiff alleged that he was originally terminated shortly after he told his employer that he was to be deployed to Iraq. When he returned from service his original position had been filled and he was offered another position for which he had no experience and was offered no training. He was later fired from this position and given no explanation for these actions.

On 11/01/2005, the District Court (Judge Marsha J. Pechman) entered a Consent Decree approved by both parties. S.O.G. Specialty Knives Inc. agreed to provide the plaintiff with compensatory back-payments.
