In 1988, an attorney in Miami filed a lawsuit in the U.S. District Court for the Southern District of Florida, seeking to compel the government to produce documents regarding the relocation and the granting of asylum to Haitian immigrants under the Freedom of Information Act, 5 U.S.C.S. § 552 et seq. The District Court (Chief Judge James Lawrence King) ordered that the documents be produced by order dated March 1, 1989. The government waited until the last day under the order to produce the documents. Plaintiff then moved for an award of attorney's fees.
Judge King awarded $139.25 for costs and $2,750.00 for attorney's fees, finding that plaintiff substantially prevailed in the case and that the public interest benefited from plaintiff bringing the lawsuit. Ray v. Department of Justice, 716 F.Supp. 1449 (S.D. Fla. 1989).
