In 1985, petitioners, as next friends of Ukrainian seaman Medvid, filed a petition for writ of habeas corpus in U.S. District Court for the Eastern District of Louisiana, seeking an order compelling the U.S. government to stop the departure of the Soviet vessel SS Marshal Konev without first releasing seaman Medvid for inquiry into voluntariness of his expressed desire to return to the Soviet Union.

The District Court (Judge Feldman) denied the petition, holding that the administrative ability to deter the ship's departure was not sufficient constructive control over seaman Medvid to warrant habeas relief. Medvid by Medvid v. Lambert, 621 F.Supp. 575 (E.D. La.,1985).
