This case concerns the United States Department of Justice’s effort to obtain election records from the State of Georgia as part of an investigation into compliance with federal voter registration laws.

On December 18, 2025, the United States filed suit in the U.S. District Court for the Middle District of Georgia against Brad Raffensperger, in his official capacity as Secretary of State of Georgia. The complaint sought declaratory and injunctive relief requiring production of election records under Title III of the Civil Rights Act of 1960.

According to the complaint, Title III requires state election officials to retain and preserve records relating to voter registration and other acts requisite to voting in federal elections, and it authorizes the Attorney General to demand access to those records for inspection, copying, and reproduction. The complaint further alleged that Title III creates a summary judicial proceeding in which a court may order production once the Attorney General shows that a proper written demand was made and the custodian refused to comply.

The complaint arose from a federal investigation into Georgia’s compliance with the National Voter Registration Act (“NVRA”) and the Help America Vote Act (“HAVA”). According to the complaint, those statutes require states to maintain accurate voter registration records, preserve records concerning list-maintenance activities, and maintain a centralized statewide voter registration list containing identifying information for registered voters.

The complaint alleged that the Attorney General first contacted Secretary Raffensperger on July 9, 2025, seeking information about Georgia’s compliance with federal election law. On August 7, 2025, the Department of Justice renewed that request and sought a current copy of Georgia’s statewide voter registration list containing all fields required by HAVA. One week later, on August 14, 2025, the Department clarified that the requested file was to include each registrant’s full name, date of birth, residential address, and either a driver’s license number, the last four digits of a Social Security number, or a HAVA unique identifier.

According to the complaint, after numerous follow-up efforts, Secretary Raffensperger responded on December 8, 2025 by refusing to provide the complete file. The response cited Georgia law restricting disclosure of full birth dates, Social Security numbers, and driver’s license numbers, and it produced only redacted voter registration information.

The complaint asserted a single claim under Title III of the Civil Rights Act, alleging that the Attorney General made a valid written demand for records covered by 52 U.S.C. § 20701 and that the Secretary failed to make those records available as required by 52 U.S.C. § 20703. The United States sought declaratory relief and an order requiring production, within five days of a court order, of the complete computerized statewide voter registration list with all requested fields. 

On January 21, 2026, Defendant moved to dismiss the complaint for lack of subject matter jurisdiction and failure to state a claim. Two days later, on January 23, 2026, the court granted the motion and dismissed the case without prejudice for lack of subject matter jurisdiction. WL 184233. The court held that the specific jurisdictional provision governing Title III record-demand actions requires suit to be brought either in the district where the demand was made or where the requested records are located, and that neither condition was satisfied in the Middle District of Georgia. Id. Rejecting the United States’ argument that electronic records are “located” wherever they can be accessed, the court concluded that both the demand and the administration and production of the records occurred in the Northern District of Georgia, leaving the court without jurisdiction. Id.

That same day, the United States refiled the action in the U.S. District Court for the Northern District of Georgia. The new complaint asserted the same claim under Title III of the Civil Rights Act and sought identical declaratory and injunctive relief. It relied on the same factual allegations and legal theory as the original filing, differing primarily in correcting the jurisdictional defect identified by the court.

On January 27 and 28, 2026, Black Voters Matter Fund and affiliated labor groups, and separately Common Cause and voter Rosario Palacios, moved to intervene as defendants. Shortly thereafter, on January 30, 2026, the court granted both motions, allowing those groups to participate in the case as defendant-intervenors.

Secretary Raffensperger again moved to dismiss, on February 5, 2026, but this time in the Northern District of Georgia, arguing that the complaint failed to state a claim even if filed in the proper district. 

On February 12 and 13, 2026, the Common Cause intervenors and the Black Voters Matter intervenors each filed their own motions to dismiss, likewise arguing that the Civil Rights Act did not require production of the unredacted voter file sought by the United States. A week later, on February 19, 2026, the United States filed a combined opposition to the pending motions to dismiss and a cross-motion to compel production of the requested election records. On February 24, 2026, the NAACP, the NAACP Georgia State Conference, the Georgia Coalition for the People’s Agenda, and an individual voter moved to intervene as additional defendant-intervenors. 

On March 5, 2026, Secretary Raffensperger filed two separate briefs. First, he filed a reply in further support of his own motion to dismiss; that filing responded to the United States’ arguments against dismissal and sought to reinforce why the complaint should be thrown out. Second, he filed a response in opposition to the United States’ cross-motion to compel; that filing addressed the government’s request for affirmative relief on the merits and argued that the court should deny the motion to compel production of the records. 

That same day, the Black Voters Matter intervenors and the Common Cause intervenors each filed combined briefs opposing the United States’ cross-motion to compel and replying in support of their respective motions to dismiss. Also on March 5, 2026, former employees of the U.S. Department of Justice moved for leave to file an amicus brief, and the NAACP intervenors sought leave to file a response in opposition to the cross-motion to compel.

On March 10, 2026, the court granted the former DOJ employees’ motion and designated them as amici curiae. Two days later, on March 12, 2026, the court granted the Democratic National Committee’s motion for leave to file an amicus brief, which was subsequently filed. The court also granted the NAACP intervenors’ motion to file a response opposing the United States’ cross-motion to compel and directed them to file that response within five days.

The following day, the NAACP intervenors filed their own motion to dismiss. That same day, they and affiliated organizations filed a response in opposition to the United States’ cross-motion to compel.
