In this case, the United States challenged the State of Maine’s alleged violation of federal voting laws. The U.S. Department of Justice, Civil Rights Division (DOJ) must ensure that States conduct voter registration list maintenance “to prevent inclusion of ineligible voters on any State’s voter registration list.” On July 24, 2025, DOJ requested details regarding the State of Maine’s compliance with voting registration list maintenance processes and the lists themselves. In a response letter sent on August 8, Maine’s Secretary of State, Shenna Bellows, refused to “provide sufficient details” in response to all of DOJ’s requests, citing statute-protected privacy concerns.

On September 16, the United States (plaintiff) sued the Secretary of State of Maine, Shenna Bellows, and the State of Maine, alleging that defendants have failed to comply with the important mandates of the National Voter Registration Act (NVRA) and Help America Vote Act (HAVA) by refusing to provide necessary information to enable the United States to assess its compliance. Plaintiffs sought to compel the State of Maine and its chief state election official, Secretary of State Bellows, to provide information regarding the State’s voter list maintenance procedures and an electronic copy of the statewide voter registration list including all fields, to allow the Attorney General to effectively assess Defendants’ compliance with the requirements of the NVRA and HAVA. Plaintiffs also filed a Motion to Show Cause why Defendants should not be compelled to produce records demanded pursuant to the Civil Rights Act of 1960 on September 18. 

On September 23, John Schneck and Marpheen Chann filed a Motion to Intervene as Defendants, claiming a right to intervene because of “an interest in ensuring the continued privacy of their personal information” which the DOJ’s actions threatened. League of Women Voters of Maine also filed a Motion to Intervene as Defendant on September 29. They claimed that, as “one of Maine’s oldest and most well-established pro-democracy organizations,” their members’ personal information could be “unlawfully shared depending on the outcome” of this case. 

On October 1, after the federal government shutdown, plaintiff filed an unopposed Motion to Stay for Lack of Appropriations. On October 2, Magistrate Judge Karen Frink Wolf granted the Motion. The Motions to Intervene remained open. Also on October 2, the case was reassigned from the Magistrate Judge Fink to Judge Lance E. Walker.

This case is ongoing.
