On April 11, 2025, five international students—attending school on F-1 visas—filed this lawsuit in the U.S.  District Court for the Northern District of California, against President Donald Trump, the Secretary of Homeland Security, the Acting Director of Immigration and Customs Enforcement, and the Acting Director of the ICE San Francisco Field Office. In early April, the defendants had abruptly terminated the plaintiffs', and other international students’, record in the Student and Exchange Visitor Information (SEVIS) system, effectively stripping them of their ability to remain a student in the United States. The plaintiffs alleged that the defendants actions were unlawful and designed to coerce them and other international students into abandoning their studies and self-deporting in contravention to the Administrative Procedure Act and the Fifth Amendment.

The plaintiffs argue that SEVIS termination is unlawful unless a student actually violates the terms of their status, and they argue that none of them did. They seek declaratory and injunctive relief restoring their SEVIS status and preventing further enforcement actions or removal based on the unlawful terminations. The case was originally assigned to District Judge Noel Wise.

On April 16, the plaintiffs moved for a temporary restraining order (TRO) to enjoin the defendants from (1) arresting and incarcerating the plaintiffs pending the resolution of these proceedings; (2) transferring the plaintiffs outside the jurisdiction of this district pending the resolution of these proceedings; and (3) preventing any legal effect that the unlawful termination of the plaintiffs' SEVIS statuses or the potential unlawful revocation of their F-1 visas may have.

The following day, the court granted the plaintiffs' motion for a TRO, preserving the status quo pending further developments in this case.  The case was then marked as related to Doe v. Trump, 4:25-cv-03140  and reassigned to that case's judge, Jeffrey White, who held a hearing on April 25 and extended the TRO.  Numerous other cases were also marked related, and the Clearinghouse will follow the ongoing litigation in that case's record, here

The court granted Plaintiffs' motion for preliminary injunction in Doe v. Trump on May 22, applying the order across seven separate cases. The court found overwhelming evidence that (1) DHS treats SEVIS as the definitive record of F-1 status, (2) schools treat SEVIS termination as loss of lawful status, and (3) students lose work authorization and face removal after termination. Thus, even though ICE later reinstated SEVIS records retroactively, the court found the disruption to education and employment cannot be undone. Defendants appealed the PI to the 9th Circuit Court of Appeals on June 21, 2025.

On August 22, 2025, the Ninth Circuit granted, in part, and denied, in part, the defendants’ motion to stay pending appeal. The court upheld the universal scope of the injunction, finding that Trump v. CASA did not bar nationwide relief under the Administrative Procedure Act, and concluded that the defendants had not shown irreparable harm. The court modified the arrest and transfer provisions, allowing arrests only if based on new material information unrelated to the SEVIS terminations, but denied any modification to the reversal provision, maintaining that defendants cannot reverse reinstated SEVIS records without court approval. The following month, on September 10, the court issued an order granting, as modified, the parties' stipulation to stay proceedings.

On November 22, 2025, The Ninth Circuit remanded the consolidated appeal to the district court. This remand was for the limited purpose of enabling the district court to modify the May 22, 2025 preliminary injunction to conform with its ruling on the motion to stay. The district court modified its PI within the Appellate court's parameters on November 26, 2025. Secretary Noem, Acting Director Lyons, and Acting Field Director Becerra, as well as their officers, were once again enjoined (1) from arresting or transferring plaintiffs or those similarly situated pending resolution of these proceedings, and (2) from reversing the reinstatement of the SEVIS record of the Plaintiffs in these cases.

On February 4, 2026, the defendants filed a motion to voluntarily dismiss the Ninth Circuit Appeal as to all consolidated cases. The motion was granted and the appeal was dismissed on February 5, 2026. 

On February 6, 2026, the district court ordered the parties to confer and file a joint status report indicating whether the matters in this case were resolved, and if not, to propose a case management schedule for the court’s consideration. 

On February 23, 2026, the parties filed a joint status report per the court’s order, indicating that they began to meet and confer to discuss the remaining disputed issues asserted in the original complaints in this litigation, and whether they could be resolved without further involvement of the Court. According to the status report, these discussions excluded the claims asserted against the Department of State in the amended complaint in Chen v. Noem, No. 25-cv-3292, which were the subject of a pending motion to dismiss. The parties indicated that the plaintiffs were in the process of preparing demands to submit to defendants, and the parties would thereafter engage in negotiations in an attempt to resolve these cases.
