In September 2004, the Los Angeles District Office of the EEOC brought this lawsuit against Clougherty Packing Company, doing business as Farmer John, in the U.S. District Court for the Central District of California. The complaint alleges that defendant discriminated against the charging parties, African Americans job applicants, by failing to hire employees based upon their race in violation of Title VII of the Civil Rights Act of 1964. Following a settlement conference, the parties settled the lawsuit in October 2005 through a consent decree.

The four-year decree required the defendant to: post the terms of the decree in a place frequented by employees, provide two three-hour EEO training sessions to managerial employees, maintain and audit their records regarding employment applications, and pay $110,000 to be divided between the seven charging parties.
