The Philadelphia Office of the EEOC filed this action in the District Court for the Eastern District of Pennsylvania. The Defendant was C. Politis & Company, an upholstery and furniture repair company. The lawsuit was filed in September 2004 and was eventually resolved through a voluntary dismissal in January of 2005. The Defendant filed a motion to dismiss on the basis that it was not an "employer" under Title VII; the motion was not resolved before the voluntary dismissal by the parties.
