The Oklahoma City and Dallas District Offices of the EEOC brought this suit against John Pickle Company, Inc in the United States District Court for the Northern District of Oklahoma in December 2002. The complaint alleged discrimination on the basis of national origin (East Indian) and race (Asian) and disparate terms and conditions of employment, pay, and harassment in violation of Title VII of the Civil Rights Act of 1964. The complainants, 52 East Indians, brought suit against John Pickle Company, Inc and John Pickle, Jr in the United States District Court for the Northern District of Oklahoma in February 2002. Their complaint alleged violations of Title VII, the Fair Labor Standards Act, the Immigration Reform and Control Act, ß1981, and state tort law for false imprisonment, deceit and intentional infliction of emotional distress. The EEOC moved for consolidation the same day it filed its complaint, which was granted in January 2003. In the private plaintiffs' case, prior to consolidation the court denied two motions to dismiss by the defendant, granted in part two motions to dismiss by the defendant, and held several status conferences. Subsequent to consolidation, several more status conferences were held, and two non-jury trial phases were held in September 2003 and March 2005. After the second phase of bench trial in March 2005, judgment was granted for the plaintiffs in October 2006. The complainants were awarded a total of $1,240,000.
