Case Summary

The EEOC's Milwaukee office filed this suit on September 24, 2002 in the U.S. District Court for the Southern District of Iowa Eastern Division. The EEOC alleged that defendant, The Dial Corporation, violated Title VII by using an employment test that discriminated against women and created an unlawful disparate impact.

Cross-motions for summary judgment were both denied. The case went to trial and the jury found for the plaintiff. The defendant was ordered to pay $3,390,000 in back pay to 52 complainants and offer all complainants the positions they were denied. The defendant filed a notice of appeal on November 23, 2005. The Eighth Circuit Court of Appeals affirmed the lower court's decision on November 17, 2006. EEOC v. Dial Corp., 469 F. 3d 735 ( 8th Cir. 2006).
