The Chicago District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Illinois, against Primps L.L.C., d/b/a Supercuts, Inc. The complaint, filed in August 2005, alleged national origin discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant had discriminated against the charging parties based on their national origin, Hispanic, by maintaining a policy that required employees to only speak English. Two of the complainants intervened in November 2005.

The parties entered a consent decree in October 2006. The decree, valid for one year, required Defendant to pay the three charging parties a total of $5,000 (individual amounts not disclosed in the decree), and enjoined Defendant from retaliating in violation of Title VII.
