In August 2005 the Houston office of the EEOC brought this suit against EGS Electrical Group, LLC and Emerson Electrical Company in the U.S. District Court for the Southern District of Texas. In its complaint, the EEOC alleged that the defendant violated the Equal Pay Act and Title VII by engaging in sex-based wage discrimination. Two female charging parties were allegedly paid less than a male counterpart, and one party was allegedly retaliated against for filing a charge of discrimination.

In January 2007 the defendant filed a motion for summary judgment, which was denied in March 2007. The case was resolved by the entry of a consent decree in May 2007. The decree awarded $45,000.00 to each of the two female complainants, and their salaries were increased to match that of a male comparator. The defendant was required to provide Title VII and Equal Pay Act training to its employees, post a notice of rights at its Houston facility, and report to the EEOC annually with all complaints of sex-based wage discrimination.
