The St. Louis District office of the EEOC brought this suit against Allstate Insurance Company, a major insurance provider, in October 2004 in the U.S. District Court for the Eastern District of Missouri. The complaint alleged that Allstate's re-hiring policy disproportionately and adversely impacted workers over the age of 40, in violation of the Age Discrimination in Employment Act. Both sides filed motions for partial summary judgment in June 2006, and in October 2006 the district court denied Allstate's motion but granted in part the EEOC's motion. Allstate was given leave in the district court in January 2007 to file an interlocutory appeal, at which point the case was stayed pending the result of that appeal. The appeal is still ongoing in the U.S. Court of Appeals for the Eight Circuit, and the district court case is thus still stayed, as of April 22, 2008. The most recent occurrence in the case was that the parties filed a status report with the district court indicating the status of the ongoing appeal.
