On February 15, 1994, inmates in the St. Joseph County Jail in South Bend, Indiana, filed a class action lawsuit in the U.S. District Court for the Northern District of Indiana, under 42 U.S.C. § 1983, against prison officials, challenging the conditions of confinement, including overcrowding. The incarcerated people were represented by private counsel. On October 18, 1994, the court (Chief Judge Allan Sharp), determined that the lawsuit should be maintained as a class action and consolidated all pending and subsequently filed litigation regarding the conditions at the St. Joseph County Jail. The class was certified on January 18, 1995. After negotiations, the parties reached a settlement which placed limitations on the jail's population. The District Court conducted a fairness hearing on May 31, 1996, and on June 5, 1996, Magistrate Judge Robin Pierce made a report and recommendation that the partial interim consent decree be approved and entered. Winston v. Nagy, No. 3:94-cv-00150, 1996 U.S. Dist. LEXIS 12107 (N.D. Ind. June 5, 1996). Following further negotiations, the parties came to a full settlement, and on June 21, 1996, The court (Judge Sharp) issued an order approving the proposed settlement, on the condition that it was approved by a majority of the St. Joseph County Council after a public hearing. On July 23, 1996, the Council approved the consent decree. On August 2, 1996, the court (Judge Sharp) made findings and recommended that the settlement be approved and the consent decree entered by the court. Winston v. Speybroeck, No. 3:94-cv-00150, 1996 WL 476662, (N.D. Ind. Aug. 2, 1996). The consent decree required the County to construct a new jail with a capacity of at least 600, to maintain a program of classification and segregation of dangerous individuals, to ensure all people have a bunk or mattress, improve the ventilation and recreation opportunities, and the plaintiff class agreed to waive any claims for damages. On August 14, 1996, the court (Judge Sharp) made findings, and recommended that the partial interim consent decree, placing a cap on the inmate population, be entered by the court. Winston v. Speybroeck, No. 3:94-cv-00150, 1996 WL 476692, (N.D. Ind. Aug. 14, 1996). On February 7, 1997, the plaintiffs moved to have the consent decree enforced by an order for the defendants to construct a new jail. On March 27, 1997, the court (Judge Sharp) ordered that efforts of defendants and plaintiffs be put on hold in order to modify the prior order pertaining to construction of a new jail. On June 6, 1998, the defendants moved to have prospective relief terminated. On July 13, 1998, the court (Judge Sharp) dismissed the motion to terminate for lack of jurisdiction. On June 21, 2000, the St. Joseph County Jail filed a contingency plan with the court for addressing extreme inmate population situations. On July 16, 2001, the court (Judge Sharp) dismissed the case.
