Case Summary

In January 2001 the St. Louis district office of the EEOC brought this suit against Exel, Inc. f/k/a Exel Logistics in the U.S. District Court for the Eastern District of Missouri. The complaint is unavailable, however court documents indicate that the EEOC alleged on behalf of a charging party a violation of the Americans with Disabilities Act. The EEOC alleged that the defendant took adverse employment actions against the charging party because he was perceived as disabled. The defendant filed a motion to dismiss in May 2001, which was later denied. The parties attempted to resolve the case through Alternative Dispute Resolution in February 2002, but the case did not settle. In May 2002 the defendant filed a motion for summary judgment. The defendant's motion was granted in June 2002, and the case was dismissed. See E.E.O.C. v. Exel, Inc., 208 F. Supp. 2d 1013 (E.D. Mo. 2002).
