In May 1999, the Miami District Office of the EEOC filed this action against Lee County, FL in the U.S. District Court for the Middle District of Florida. The complaint alleged discrimination by the defendant in violation of the Age Discrimination in Employment Act ("ADEA"). The defendant discriminated against two charging parties, one sixty years of age and the other sixty-one years of age. Specifically, the defendant discharged two well-qualified employees from their positions and replaced them with younger individuals, and the defendant retaliated against the charging parties because they had previously taken part in an investigation of age discrimination. After some scheduling orders, the parties settled in July 2000.
Under the three-year consent decree, which contained a non-discrimination clause, the defendant agreed to: develop a written ADEA policy, provide ADEA training to all employees, post an EEOC approved notice, retain records of age discrimination, report to the EEOC every six months on compliance, and pay a total of $350,000.
