In September 2001, the Charlotte District Office of the EEOC brought this suit against Masonry Reinforcing Corporation of America in the U.S. District Court for the Western District of North Carolina alleging discrimination on the basis of sex in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant subjected the two charging parties and other female employees to a sexually hostile work environment consisting of unwelcome touching, sexual advances, and derogatory comments. After a single scheduling order and some discovery, the parties settled in early July 2002 through a consent decree.
The two-year decree, containing non-discrimination and non-retaliation clauses, required the defendant to: expunge one of the charging party's personnel files of all references to the charges of discrimination, revise its anti-harassment policy, provide Title VII training for all employees, report to the EEOC at specified intervals, post a notice of the decree, provide neutral employment references for three of the complainants, and pay $45,000 to be distributed among three individuals.
