Specifically, the complaint alleged that the defendant subjected the two charging parties and other female employees to a sexually hostile work environment consisting of unwelcome touching, sexual advances, and derogatory comments. After a single scheduling order and some discovery, the parties settled in early July 2002 through a consent decree.

The two-year decree, containing non-discrimination and non-retaliation clauses, required the defendant to: expunge one of the charging party's personnel files of all references to the charges of discrimination, revise its anti-harassment policy, provide Title VII training for all employees, report to the EEOC at specified intervals, post a notice of the decree, provide neutral employment references for three of the complainants, and pay $45,000 to be distributed among three individuals.
