The EEOC's Chicago office filed this suit on February 2, 2006 in the U.S. District Court for the Northern District of Illinois, Chicago Division. The complaint alleged that defendant Infinity Home Improvement, Inc., doing business as Gutter Helmet, created a hostile working environment for three black employees and retaliated against two complainants for their opposition to the practice. The parties attended two settlement conferences and three status hearings during the case. The defendant moved for summary judgment on October 20, 2006 but a settlement was reached before a decision was made on the motion. A proposed consent decree was filed on November 17, 2006 and the consent decree was entered into the record on November 20, 2006. The defendant agreed to pay four complainants a total of $75,000. The defendant also agreed to provide annual training for its employees, maintain records of complaints and firings and send semi-annual reports to the EEOC during the two year consent decree. The docket sheet does not show any further enforcement; the case was presumably closed in 2008.
