The EEOC's Memphis district office sued Memphis Lamp, Inc. on April 27, 2001 in the U.S. District Court for the Western District of Tennessee. The EEOC's complaint alleged that the defendant violated Title VII when it discriminated based on race (African American) by failing to hire and promote African American workers and retaliating against a current employee by terminating her employment when she complained of the practice. The defendant filed a motion for summary judgment on January 27, 2003, which was never resolved. The parties entered into a consent decree on July 1, 2003, which stipulated that the defendant would pay the complainants $22,875 in damages, post a notice of compliance with Title VII, distribute a non-discrimination policy, maintain records required by the EEOC, provide neutral references to the complainants, allow the EEOC to examine records, and report compliance with the consent decree.
