In December 1997, the Chicago District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Illinois against First Midwest Bank, NA. The EEOC claimed that First Midwest Bank engaged in sex discrimination against female employees by denying them promotions to executive positions. The suit sought monetary damages and an injunction forbidding First Midwest Bank from engaging in sex discrimination. The EEOC sued under Title VII of the Civil Rights Act…

In December 1997, the Chicago District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Illinois against First Midwest Bank, NA. The EEOC claimed that First Midwest Bank engaged in sex discrimination against female employees by denying them promotions to executive positions. The suit sought monetary damages and an injunction forbidding First Midwest Bank from engaging in sex discrimination. The EEOC sued under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq., and Title I of the Civil Rights Act of 1991, 42 U.S.C. § 1981a.

In January 1998, Defendant moved to dismiss the complaint, but the motion was denied in July 1998. In the opinion, the district court (Judge Elaine Bucklo) criticized the EEOC's failure to engage in conciliation, noting "[t]he federal courts are not depositories for the EEOC's lackluster efforts." Judge Bucklo stayed the action for 60 days so the parties could attempt conciliation. 14 F. Supp. 2d 1028. In July 1998 the charging party intervened. In September 1998, Defendant moved again to dismiss the complaint, but the motion was denied in October 1998.

In August 1999 the parties entered a consent decree. The Clearinghouse is unaware of the decree's terms. There has been no further docket activity.
