The EEOC's Denver district office sued G&N Enterprises, Inc., the parent company of the clothing and supply store Western Way Work Warehouse, on October 30, 1998 in the U.S. District Court for the District of South Dakota. The EEOC's complaint alleged that G&N violated Title VII by discriminating against the intervenor employee based on sex (female) when it created a hostile work environment through sexual harassment and retaliated against her by terminating her employment when she complained about her treatment. The EEOC and intervenor jointly filed for summary judgment in January 2000, which was denied a month later. The case went to trial in May 2000 and the jury returned a verdict of $205,202 in punitive and compensatory damages. The court reduced the punitive damages for the intervenor's sexual harassment claim by $50,000, resulting in monetary damages of $155,202. G&N appealed the judgment in the case in June 2000, which was dismissed by stipulation of the parties in October 2000.

The EEOC sought equitable damages after the resolution of the suit in May 2000, and following the stipulated dismissal of the appeal, the EEOC and G&N entered into a consent decree in November 2000. The consent decree stipulated that G&N would not participate in future harassment, would implement a sexual harassment policy, would post a notice of compliance with Title VII, and report sexual harassment claims to the EEOC every six months for the duration of the consent decree.
