The Dallas District Office of the EEOC brought this action in the U.S. District Court for the Western District of Oklahoma, against Gardner Management Group, LLC. The complaint, filed in September 2005, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant subjected the charging parties to a sexually hostile work environment because of their sex, female, and then terminated them in retaliation for complaining about the harassment. Defendant moved for partial summary judgment in January 2007 but the motion was denied in February 2007. The EEOC then moved for partial summary judgment in May 2007, but the motion was never ruled on, and the parties entered into a consent decree in June 2007.

The decree, valid for three years, required Defendant to pay the five charging parties a total of $145,000 in compensatory damages and expunge the charging parties' records. Defendant was enjoined from discriminating in violation of Title VII, required to post a notice of non-discrimination, provide Title VII training to its employees, and report regularly to the EEOC about any internal complaints of sexual harassment.
